Preliminaries

These General Terms and Conditions (the “General Terms”) regulate the online sale of products (the “Products” or the “Product”) available through the website www.artigianodellanduja.com (the “Website”). The seller of the Products and owner of the Website is L’Artigiano della ‘Nduja S.r.l., with its registered office in Spilinga (VV), C.da San Francesco, SP22, Spilinga, Italy, email: info@artigianodellanduja.com, VAT number IT034489800791, REA number (L’Artigiano della ‘Nduja S.r.l.).

All contractual relations between L’Artigiano della ‘Nduja S.r.l. and any consumer who makes purchases on the Website (the “Customer”) are governed by these General Terms, which are an integral and substantial part of each proposal, order, and order confirmation for the purchase of the Products.

Each purchase operation will be governed by the provisions of Legislative Decree 185/99 and Legislative Decree 206/05, as amended by Legislative Decree 21/2014. Information regarding the conclusion of the contract will be subject to the provisions of Article 12 of Legislative Decree 70/03, and with regard to the protection of privacy, the provisions of EU Regulation 2016/679 (the “GDPR”) will apply.

These General Terms are valid for all orders and shipments made through the Website and can be viewed and saved in PDF format. These General Terms may be modified at any time by L’Artigiano della ‘Nduja S.r.l., without prejudice to sales operations already completed.

Registration is allowed only to the consumer Customer, a natural person who has reached the age of majority and uses the Website for purposes not related to their commercial, entrepreneurial, or professional activity.

  1. Choosing and Ordering Products

The characteristics and prices of the various products for sale on the Website (hereinafter referred to as “Product” or “Products”) are listed on the page corresponding to each Product.

To purchase the Products, the Customer must complete and submit the order form in electronic format, following the instructions provided on the Website. The Customer must add the Product to the “Cart” and, after reviewing the General Terms and the Privacy Policy and confirming their acceptance, must enter shipping and, if applicable, billing information, select the desired payment method, and confirm the order.

By submitting the order through the Website, which serves as a contractual proposal, the Customer acknowledges and declares that they have reviewed all the information provided during the purchase process and accept these General Terms and payment terms in full.

The contract between L’Artigiano della ‘Nduja S.r.l. and the Customer is considered concluded upon acceptance of the order by L’Artigiano della ‘Nduja S.r.l. This acceptance is communicated to the Customer via an email confirming the order, which will include a reference to these General Terms, the order number, shipping and billing details, a list of the ordered Products with their essential characteristics, and the total price, including delivery costs. The Customer will check the confirmation email and, if they find any errors in the order, they will have 12 hours from receiving the email to contact Customer Service directly from the Website using the contact form. After this period, the order will be processed for shipment, and no modifications will be accepted, without prejudice to the Customer’s rights as outlined in the following Article 7.

Once the order is received, L’Artigiano della ‘Nduja S.r.l. will verify the availability of stock to fulfill the order. If one or more Products are unavailable, L’Artigiano della ‘Nduja S.r.l. Customer Service will promptly notify the Customer via email. The Customer will have 12 hours to respond and confirm the shipment of any available Products or cancel the order. If no response is received within this period, the order will be considered confirmed, and the available Products will be shipped. If only a few Products are out of stock, L’Artigiano della ‘Nduja S.r.l. will proceed with the shipment of the available Products. In both cases, the amount for the missing Products will be immediately refunded depending on the chosen payment method.

  1. Product Information

Information and characteristics of the Products are available, along with the corresponding product codes, on the Website. The visual representation of the Products on the Website, if available, typically corresponds to the photographic image accompanying the product description. It is understood that the image of the Products is only intended to present them for sale and may not perfectly represent their characteristics and quality, as it may differ in color and size. In case of discrepancy between the image and the written product description, the written product description shall prevail.

  1. Prices and Shipping

Information and characteristics of the Products are available, along with the corresponding product codes, on the Website. The prices of the products include all taxes and duties. All prices are expressed in Euro.

Shipping in Italy varies based on weight.

International Shipping:

The cost of international shipping varies based on weight, and the countries served are listed in the dropdown menu.

The Customer can pay for the Products and related delivery costs via credit card, PayPal, bank transfer, or prepaid cards.

5.1 Payment Methods: NOT AVAILABLE AT THE MOMENT ( ITALY ONLY)

Credit Cards:

The available credit card networks on the Website are:

  • Visa / Visa Electron
  • Mastercard
  • American Express

To ensure maximum security, the Customer will make the payment transaction directly on the PayPal secure server.

The Website does not store the Customer’s credit card number, but thanks to the protected communication system of the bank, the Customer can, from the second purchase onwards, proceed with the purchase without re-entering their details, provided they select the appropriate option. The bank uses SSL protocol to encrypt the data transmitted between its server and the Customer’s browser.

PayPal:

Once the order is confirmed, the Customer will be redirected to the PayPal site, where they can pay using their account or a card, including prepaid cards, or according to the accepted PayPal methods and terms.

Advance Bank Transfer:

The Customer must make the bank transfer within 3 days from the order date for product orders. If payment is not made within 3 days, the order will be canceled, and the goods will be made available for purchase by other Customers. The Customer who has not made the transfer may be contacted by Customer Service to clarify whether the failure to transfer is due to the Customer’s intention not to confirm the purchase or other reasons.

5.2 Billing of Orders

If the purchase is made by a professional, they may request an invoice by selecting the appropriate checkbox during the order process and entering billing information, including tax code and/or VAT number. In this case, the invoice will be sent by email to the specified address. The professional is responsible for correctly entering the billing information and is expressly informed that if the invoice request is not made during the order, it cannot be requested later.
